Welcome to Create Joy Studios. These Terms of Service (“Terms”) govern your use of this website and any purchases made through Create Joy Studios.

By visiting this website, creating an account, placing an order, subscribing to a recurring purchase, or otherwise using our services, you agree to these Terms. Please read them carefully before using the website or making a purchase.

Create Joy Studios is powered by Shopify, which provides the ecommerce platform that allows us to offer our products and services to you.

1. Online Store Terms

By using this website, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have permission from a parent or legal guardian to use the Services.

You may not use our products or website for any unlawful or unauthorized purpose.

You may not transmit viruses, malicious code, or other material intended to interfere with or damage the website, Shopify, or any related service.

A violation of these Terms may result in termination of your access to the Services.

2. Products and Artwork

Create Joy Studios offers products that may include:

Original artwork
Fine art prints and reproductions
Books and illustrated works
Art collections and subscription products
Other art-related or creative products

Original artwork is handmade and one-of-a-kind. Variations in color, texture, brushwork, paper, surface, or other artistic characteristics are part of the nature of original artwork and are not considered defects.

Colors displayed on computer monitors, tablets, and mobile devices may vary from the colors of the physical artwork or print. We cannot guarantee that your device will display colors with complete accuracy.

Fine art prints and subscription prints may be produced specifically for each order by a professional printing and fulfillment partner.

3. Product Descriptions and Images

We make reasonable efforts to accurately describe and photograph our products, including dimensions, materials, colors, and other details.

However, slight differences may occur between photographs displayed online and the physical product.

Please carefully review the product description, photographs, dimensions, and purchase options before placing an order.

4. Pricing

Prices are shown in the currency displayed on the website and are subject to change without notice.

We reserve the right to correct pricing errors, typographical errors, inaccurate product information, or other mistakes.

If an error affects an order you have already placed, we may contact you to provide the correct information and, when appropriate, give you the option to proceed with or cancel the affected order.

5. Orders

We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in cases involving:

Suspected fraud
Payment problems
Incorrect pricing or product information
Inventory errors
Technical problems
Shipping restrictions
Other circumstances that prevent us from reasonably fulfilling the order

If we cancel an order after payment has been collected, any amount due back to you will be refunded using the appropriate payment method.

6. Payment

Payment must be successfully processed before an order can be completed unless another arrangement is specifically offered through the website.

Payments may be processed by Shopify Payments or other third-party payment providers available through checkout.

Create Joy Studios does not directly store complete payment-card information submitted through Shopify's secure checkout.

If a payment cannot be processed, you may be asked to submit payment again before the order can proceed.

7. Shipping and Fulfillment

Create Joy Studios sells both original artwork and products that may be produced or shipped by professional fulfillment partners.

Original artwork is prepared and packaged for shipment after an order is received.

Made-to-order prints and subscription prints may require production time before shipment.

Processing times and delivery estimates are estimates only and may be affected by production schedules, carriers, weather, holidays, destination, or circumstances outside our reasonable control.

Tracking information will be provided when available.

Please review our separate Shipping Policy for additional information regarding processing, delivery, tracking, address errors, delayed packages, and damaged shipments.

8. Returns, Exchanges, and Refunds

Because Create Joy Studios offers original artwork and made-to-order fine art prints, all sales are final unless otherwise required by applicable law.

We do not accept returns, exchanges, or refunds for:

Change of mind
Buyer's remorse
Incorrect size selection by the customer
Personal preference
Minor variations inherent in original artwork
Reasonable differences between screen colors and physical artwork or prints

Original artwork is one-of-a-kind and cannot be returned or exchanged once purchased.

Fine art prints are produced specifically for each order and cannot be returned or exchanged for change of mind.

If an item arrives damaged, defective, or incorrect, please contact hello@createjoystudios.com as soon as possible and include your order number and clear photographs of the item and packaging.

When appropriate, we will review the situation and determine whether a replacement, refund, or other resolution is warranted.

Nothing in these Terms limits any consumer rights that cannot legally be excluded.

9. Subscriptions and Recurring Purchases

Create Joy Studios may offer recurring subscription products, including The Little Joy Art Club.

The Little Joy Art Club is currently offered at $10.00 per month. By purchasing a subscription, you authorize Create Joy Studios to automatically charge your selected payment method each month until the subscription is canceled.

Subscriptions automatically renew each month unless canceled before the next scheduled billing date.

You may cancel your subscription at any time through your customer account using the Manage Subscription option.

There are no long-term commitments or cancellation fees.

If a subscription payment has already been processed before cancellation, that month's order may still be fulfilled and the cancellation will apply to future billing periods.

Subscription charges that have already been processed are generally non-refundable except where required by applicable law or where Create Joy Studios determines that a refund or replacement is appropriate because of a damaged, defective, or incorrect order.

Subscription prices, products, or benefits may change in the future. If a change affects an existing subscription in a manner requiring notice or consent under applicable law, appropriate notice will be provided.

10. Incorrect Shipping Information

Customers are responsible for providing a complete and accurate shipping address.

If you discover an error after placing an order, contact us as soon as possible at hello@createjoystudios.com.

We cannot guarantee that shipping information can be changed once an order has entered production, fulfillment, or shipment.

Additional costs resulting from an incorrect address supplied by the customer may be the customer's responsibility to the extent permitted by law.

11. Intellectual Property

Unless otherwise stated, all original artwork, illustrations, photographs of artwork, written content, books, designs, graphics, logos, product descriptions, and other creative content created by Create Joy Studios and displayed or sold through the website are protected by applicable copyright and intellectual-property laws.

Purchase of an original artwork or print transfers ownership of the physical item only.

Copyright and reproduction rights remain with Create Joy Studios and/or the artist unless expressly transferred in writing.

Purchasing artwork does not give the purchaser permission to:

Reproduce the artwork
Create or sell prints or copies
Use the artwork commercially
Create merchandise featuring the artwork
Distribute digital copies
Claim the artwork as their own creation
Use the artwork for artificial intelligence training or dataset creation
License the artwork to another person or company

Personal display and enjoyment of purchased artwork are permitted.

Written permission is required for commercial reproduction, licensing, publishing, or other uses beyond ordinary personal ownership.

12. Fan Art and Third-Party Intellectual Property

Certain products, where clearly identified, may reference or be inspired by popular culture or other creative works.

Any third-party trademarks, names, characters, logos, copyrighted works, or other intellectual property remain the property of their respective owners.

Create Joy Studios does not claim ownership of third-party intellectual property and is not affiliated with, sponsored by, or endorsed by third-party rights holders unless expressly stated.

Original creative elements produced by Create Joy Studios remain protected to the extent permitted by law.

Nothing in these Terms grants rights to third-party intellectual property.

13. Books and Written Works

Books, stories, illustrations, characters, and other written or illustrated works created by Create Joy Studios or its author/artist are protected by copyright.

Purchase of a book grants ownership of the purchased physical or digital copy only and does not transfer reproduction, publication, adaptation, merchandising, or other intellectual-property rights.

14. Personal Information

Your submission of personal information through the website is governed by our Privacy Policy.

Please review the Privacy Policy for information about how personal information is collected, used, disclosed, and protected.

15. Customer Accounts

If customer accounts are available, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

You agree to provide accurate and current account information.

Please contact us if you believe your account has been accessed without authorization.

Customers with active subscriptions may use their customer account to view and manage eligible subscription information.

16. Prohibited Uses

You may not use this website or its content:

For unlawful purposes
To violate applicable laws or regulations
To infringe our intellectual-property rights or the rights of others
To harass, abuse, threaten, discriminate against, or harm another person
To submit false or misleading information

To the fullest extent permitted by applicable law, Create Joy Studios will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, Services, or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability or consumer rights that cannot legally be limited or waived.

To the extent permitted by law, you agree to indemnify and hold harmless Create Joy Studios from claims, damages, liabilities, or expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will remain in effect.

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

26. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy, Purchase Options Cancellation Policy, and other policies posted on the website, constitute the agreement between you and Create Joy Studios regarding your use of the Services.
